These Terms & Conditions ("Terms") govern your use of Marketiflo (the "Service"), operated by Pinnacle Partners Alliance Ltd ("Pinnacle", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 and able to enter a binding contract. You are responsible for your account, its security, and all activity under it. Provide accurate information and keep it current.
You may cancel at any time from account settings; cancellation stops the next renewal, and access continues until the end of the paid period. We may suspend or terminate accounts that breach these Terms, that we are required to act on by law, or for non-payment. See our Refund & Cancellation Policy.
You must not use the Service to: break the law; infringe others' rights; post unlawful, deceptive, harmful or infringing content; violate the terms or policies of Meta, TikTok or other connected platforms; attempt to breach security or access others' data; resell or misrepresent the Service beyond your plan's terms; or use it for spam or abusive automation.
You retain ownership of content you create or upload. You grant us the licence needed to host, process and publish it to the accounts you connect, at your direction. You are responsible for the content you publish and for having the rights to it. You authorise us to act on your connected Meta and TikTok accounts within the permissions you grant, and you must comply with those platforms' terms.
We process personal data as described in our Privacy Policy, in line with the Data Protection Act 2017 of Mauritius.
Where you put personal data about other people into the Service (for example your clients, their customers, or people who comment on your social media), you are the controller of that data and we are your processor. Our Data Processing Agreement forms part of these Terms and applies automatically; by accepting these Terms you also enter into it. You are responsible for having a lawful basis for that data and for giving the people concerned the information the law requires.
We may send account holders occasional tips and reminders about using the Service. You can object to these at any time with the unsubscribe link in each email; service messages (security, billing, changes to these Terms) are not affected.
The Service uses AI to generate marketing content. AI output may be inaccurate or unsuitable; it is provided without warranty. You must review content before publishing, and you remain responsible for it. We do not guarantee any marketing, engagement or advertising results.
The Service, its software, design and brand are owned by Pinnacle or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service under these Terms for the duration of your subscription. You receive a licence to use the Service — not ownership of the software. You may not copy, reverse-engineer, resell or create derivative works of the Service except as permitted by law.
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, and features may change. Third-party platform outages (e.g. Meta, TikTok, payment providers) are outside our control.
The Service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Pinnacle is not liable for indirect, incidental or consequential losses, lost profits, or loss of data; and our total liability for any claim is limited to the amount you paid us for the Service in the three months before the claim.
You agree to indemnify Pinnacle against claims arising from your content, your use of the Service, or your breach of these Terms or of a connected platform's terms.
These Terms are governed by the laws of the Republic of Mauritius. Disputes are subject to the courts of Mauritius. We encourage you to contact us first to resolve any issue.
